Terms of Service

These Terms of Service (“Terms”) govern your use of Osera, operated by Bloom Street LLC (“Bloom Street,” “we,” “us,” or “our”). By using Osera, you agree to these Terms. If you do not agree, do not use Osera.


1. Experimental Software Acknowledgment

Osera is experimental software in active development. It may contain bugs, errors, and defects; produce unexpected, inaccurate, or inappropriate results; change, break, or be removed without notice; experience downtime; or cause data loss. YOU USE OSERA ENTIRELY AT YOUR OWN RISK.


2. Acceptance of Terms

By creating an account, installing the application, or using Osera, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), have read and agree to these Terms and our Privacy Policy, and accept the risks of experimental software.

By creating an account, installing the application, or using Osera, you also acknowledge that you have read and agree to the Acceptable Use Policy.


3. Service, Definitions, and Changes

Osera provides conversational, contextual, and connected-service features. Depending on enabled features and permissions, Osera may read or change connected data, communicate, create or modify records or files, navigate services, conduct transactions, run automations, send proactive heartbeats, and pursue background goals. This describes possible capabilities where enabled; it does not mean every capability or Action is currently available to every user.

Third-party AI providers may be developed or operated in different countries, and data may be processed in the United States, the European Union, or other jurisdictions. Provider routing can change. Your conversations and context may be transmitted to these providers to generate responses or perform requested services. See our Privacy Policy for details about these data flows.

We may modify, suspend, or discontinue Osera, in whole or in part, at any time, with or without notice and without liability, including changes to features, availability, supported platforms, access tiers, or pricing.


4. Account and Access

You must provide accurate and complete account information, protect your account credentials, notify us of unauthorized access, and accept responsibility for activity under your account. Access may be subject to subscription tiers, usage limits, or other restrictions we implement.


5. Acceptable Use

The Acceptable Use Policy is incorporated into these Terms. A violation of the Acceptable Use Policy is a violation of these Terms. If the Acceptable Use Policy conflicts with these Terms, these Terms control.

You agree not to use Osera to violate law or third-party rights; access or modify accounts, systems, data, credentials, or payment methods without authorization; conduct fraudulent or unlawful financial transactions; send spam; harass, surveil, impersonate, deceptively engage, or harm others; collect, disclose, or infer sensitive information without authority; provide unlicensed professional services or make unsafe automated decisions; introduce malicious code, exploit vulnerabilities, interfere with service operation, or circumvent usage limits or security measures; reverse engineer or extract source code; use automated systems to access Osera beyond normal use; or resell or commercially exploit Osera without authorization. We may suspend or terminate accounts that violate these Terms.

Bloom Street may refuse or pause an Action and may restrict or revoke access to any capability when we reasonably believe it is necessary to enforce the Acceptable Use Policy, protect Osera or others, or comply with law.


6. Inputs, Outputs, and Improvement

6.1 No Reliance

Outputs may be incorrect, incomplete, misleading, outdated, biased, or inappropriate. Osera is not a substitute for medical, legal, financial, tax, mental-health, safety-critical, or other professional advice. Consult qualified professionals for important decisions. You are solely responsible for evaluating and verifying Outputs before acting on them.

6.2 Crisis and Safety

Osera is not a mental health service, therapist, counselor, or crisis intervention tool. It is not a substitute for professional mental health treatment. If you are experiencing a mental health crisis, contact the 988 Suicide & Crisis Lifeline (call or text 988), the Crisis Text Line (text HOME to 741741), or your local emergency services.

Osera maintains automated crisis detection systems and may show referrals to crisis service providers, but these systems are not guaranteed to detect every emergency. See Safety at Osera.

6.3 Risks of Outputs and Actions

Osera may misunderstand your intent; use stale or incomplete context; choose the wrong recipient, account, or time; duplicate or omit work; disclose information; alter or delete data; incur charges; enter commitments; or take irreversible Actions. Connected messages, documents, sites, and service content can contain hidden, malicious, misleading, or hostile instructions. Safeguards and approval controls can fail, and we do not guarantee that they will catch or prevent every problem.

6.4 Personalization and Product Improvement

Private content includes message and file contents, Outputs, memories, summaries, embeddings, tool arguments and results, Connected Service contents, and sensitive facts or inferences derived from those sources. Osera processes private content to provide and personalize the service for you, including memory, responses, proactive features, and Actions you authorize.

Bloom Street does not use private content or account-linked data to train or fine-tune general-purpose or foundation language models.

We may use action-performance information such as the feature or tool used, timestamps, latency, completion state, error category, approval state, and structured reactions or correction states to operate Osera and improve reliability and safety. Account-linked operational telemetry may be used for internal product, adoption, reliability, and safety analysis. Only genuinely aggregated or deidentified telemetry may contribute to cross-user model development or generalized analysis. Free-text or otherwise content-bearing feedback remains private content.

Authorized personnel and processors may review limited, sampled private interactions for quality and safety evaluation, support, security, abuse prevention, legal compliance, or investigation of a specific reliability or safety problem, except where source-specific restrictions provide otherwise. Access is limited to what is reasonably needed for those purposes. This review is not foundation-model training.

Osera may create reusable workflows from generalized action patterns and outcomes. Reusable workflows made available across users must not contain private content, identifiers, or sensitive facts inferred from them and must be human reviewed before publication. Automatically generated action traces cannot directly become shared workflows; publication requires human review.

Passwords, OAuth tokens, API keys, integration credentials, payment credentials, session cookies, and comparable authentication or payment secrets are excluded from model development and cross-user learning. Google Workspace API data and HealthKit-originated data are not used by Bloom Street to train or fine-tune general-purpose or foundation language models or for cross-user model development. Review and personnel access involving Google Workspace API data remain subject to Google’s policies and Limited Use requirements. Google Workspace API data may not appear in a published shared workflow as private content. Credentials and authentication secrets may be used only as needed to authenticate and operate Osera or the applicable connection; no license authorizes prohibited secondary uses.

Osera’s use and transfer of information received from Google Workspace APIs complies with the Google Workspace API User Data and Developer Policy, including its Limited Use requirements. Google Workspace API data is not used to create, train, or improve a model beyond that specific user’s personalized model for the appropriate user-facing use case, and no other prohibited use is authorized.

HealthKit data is used only for permitted user-facing health features and operations. HealthKit data is not sold, used for advertising or marketing data mining, or shared with data brokers. Other source restrictions remain binding.

Bloom Street's own improvement uses are distinct from third-party AI-provider processing. Third-party AI providers receive context to perform requested services, and their provider-specific no-training or restricted-use terms may differ. Provider terms and contractual controls are not identical. A provider route that conflicts with a binding source restriction is not authorized by these Terms.

6.5 Your Content

You retain ownership of your content. You grant Bloom Street a worldwide, non-exclusive, royalty-free, sublicensable license to use, process, reproduce, and transmit Inputs as needed to operate, personalize, secure, evaluate, support, analyze action performance, and create human-reviewed generalized workflows as described in the Privacy Policy. This license does not authorize Bloom Street to use private content or account-linked data to train or fine-tune general-purpose or foundation language models. This license is subject to the Privacy Policy, source-specific restrictions, provider rules, and non-waivable rights. You represent that you have the right to provide each Input.


7. Permissions, Actions, and Connected Services

7.1 Authority for Actions

You authorize Actions arising from direct requests; your preferences and context; configured automations; Standing Permissions, including an “always allow” choice where offered; proactive heartbeats; and background goals. After you grant Standing Permission, Osera may take the covered Action without a new confirmation until you revoke or change that permission. Some Action classes remain gated, require confirmation, or are unavailable.

You can revoke or change permissions, disconnect Connected Services, and pause or stop configured activity where controls exist. You are responsible for scoping permissions and Standing Permissions, protecting credentials, monitoring important activity, reviewing high-impact Outputs and Actions when appropriate, revoking access, pausing or stopping activity, and reporting unexpected behavior.

7.2 Connected Services and Disconnection

Connecting a Connected Service authorizes Osera to access and interact with it within your instructions, settings, and Standing Permissions, subject to that service's terms. We do not control third-party services or their availability, pricing, fulfillment, reversals, or refunds.

Disconnecting a Connected Service removes or revokes connection access and stops new requests through that connection. It does not automatically delete information already incorporated into Inputs, Outputs, memory, summaries, derived data, action records, logs, backups, or generalized learnings. Account deletion is separate and governed by the Privacy Policy.

7.3 Transactions and Communications

You are responsible for connected transactions, including purchases, communications, and commitments made under authority you grant. You represent that you have authority to bind the relevant account and to authorize those Actions. Third parties, not Bloom Street, control their services and any related availability, pricing, fulfillment, reversals, or refunds.

7.4 Device, Integration, and Current-Service Limitations

Osera may request device permissions, including camera, calendar, reminders, location, photo library, and Apple Music library permissions. Some of this data may be transmitted to Osera servers and to AI providers, and on-device machine learning may analyze your photo library metadata and music library to derive interest and taste profiles. You may revoke device permissions in iOS Settings; revoking the relevant permission stops analysis and prevents new data from being synced.

Third-party services control their own data handling; you must secure credentials and remain bound by their terms of service and any applicable workplace policies.

7.5 Email Account Access (JMAP)

When you connect an email account via JMAP, you provide your email server credentials (server URL, username, and password) to Osera. They are stored on our servers to enable email functionality.

You authorize Osera to read, search, and compose emails using your account. You agree to use an app-specific password where possible. You acknowledge that email content may be included in AI requests and processed by third-party AI providers.

You are responsible for ensuring that the connection complies with your email provider’s terms and applicable workplace policies, and Bloom Street is not liable for unauthorized access resulting from compromised credentials.

7.6 Calendar, On-Device Analysis, and Derived Data

You are responsible for ensuring that you have the right to share ICS calendar feed URLs with Osera. Osera fetches these feeds automatically every 6 hours. Institutional calendars may be subject to your institution’s policies.

On-device machine learning may scan photo metadata to build an interest profile. Your actual library photos are not uploaded by this scan, but derived labels and per-photo GPS coordinates may be synced to our servers.

Music-library analysis and ShazamKit song-recognition results may be synced to our servers; weather features use location and are subject to Apple WeatherKit terms; and Osera may derive relationship intelligence from your interactions that may not be editable on a per-relationship basis.

7.7 User Compliance

You are responsible for ensuring that your use of Osera complies with applicable privacy, confidentiality, intellectual-property, and regulated-data laws. You represent that you have the rights and authority to provide third-party personal data, confidential information, medical or health records, files, and other content, and will not provide such information without authorization. To the maximum extent permitted by law, you assume responsibility and risk for compliance when you process third-party or regulated data through Osera.

7.8 Waitlist SMS and Current Messaging Features

When you provide your phone number on osera.io or text JOIN or MINE to (415) 936-7594, you consent to receive up to two text messages from Osera: a waitlist confirmation and an availability notice. No recurring or marketing messages are sent through this program. Message and data rates may apply. Reply STOP to opt out or HELP for support.

Osera does not currently expose SMS-based group messaging, chat spaces, or voice calling in the shipped iPhone app; the only shipped SMS surface is the waitlist program described above. If we launch coordinated messaging features later, these Terms will be updated before those features become generally available.


8. Payment and Subscriptions

8.1 Billing

Subscriptions may be billed by Apple through the App Store or by a payment processor for web purchases. The applicable processor’s terms, and the interval, renewal date, and price shown at checkout or purchase, govern that purchase. We do not directly store payment card details.

8.2 Introductory Offers, Free Trials, and Automatic Renewal

Osera is an automatically renewing subscription. Your subscription automatically renews at the interval and price shown at checkout or purchase until you cancel.

If your subscription begins with a paid introductory offer, the introductory amount, period, renewal date, and price that applies afterward are shown at checkout or purchase before you are charged.

If your subscription begins with a free trial, the trial length, renewal date, and price after the trial are shown at checkout or purchase before you are charged. The trial converts to a paid subscription automatically when it ends unless you cancel before then.

How to cancel. If Apple bills your subscription, cancel it through your Apple or App Store subscription settings, and Apple handles App Store refund requests. For a web-billed subscription, in the app open Osera, go to Settings, and choose Manage subscription; or on the web, sign in at osera.io/login and choose Manage subscription. For web-billed subscriptions, cancellation stops the next renewal and access continues through the already-paid period. Visit osera.io/login to manage web billing.

8.3 Refunds

Refund eligibility depends on the payment processor, applicable law, and the terms stated at checkout or purchase. Contact legal@osera.io for web-billing inquiries.

8.4 Price Changes

We may change prices for future renewals as permitted by the applicable processor and disclosed terms.


9. Intellectual Property

Osera, including its software, design, branding, and documentation, is owned by Bloom Street LLC and protected by intellectual-property law. These Terms do not grant you ownership rights. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Osera for personal or internal business purposes. If you provide feedback, you grant us the right to use it to operate, support, evaluate, and improve Osera, subject to the Privacy Policy.


10. Disclaimer of Warranties

OSERA, OUTPUTS, ACTIONS, STANDING PERMISSIONS, AND CONNECTED-SERVICE FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, uninterrupted operation, security, and freedom from viruses. We do not warrant that Osera will meet your requirements, prevent hostile instructions, or avoid connected-service failures.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOM STREET LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL.

This includes damages arising from Outputs, Actions, Standing Permissions, connected-service failures, unauthorized or hostile instructions, transactions, communications, altered or lost data, service interruptions, or reliance on Osera, regardless of theory of liability and even if advised of the possibility of damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER. Where a jurisdiction does not allow a limitation, our liability is limited to the maximum extent permitted by law.


12. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Bloom Street and its officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of Osera; your Inputs; your violation of these Terms, law, or third-party rights; Actions, transactions, communications, or data changes made under authority you grant; or third-party claims concerning data or accounts you provided without proper authorization.


13. Termination

You may stop using Osera and request account deletion at any time. We may suspend or terminate your access at any time, with or without cause, with or without notice. Reasons may include violations of these Terms or the Acceptable Use Policy, suspected fraudulent or abusive activity, extended inactivity, or discontinuation of the service.

Upon termination, your license to use Osera ends immediately, you lose access to your account and data. Disclaimers, limitations of liability, indemnification, and dispute provisions that by their nature should survive termination do survive termination. The Section 6.5 content license survives only for data and uses lawfully retained under the Privacy Policy, including legally required, security, or transaction records and aggregate, deidentified, or non-attributable, source-compliant workflows and product changes, and only for as long as and to the extent necessary and permitted. Some learned-skill records may remain after account deletion. We may replace a direct creator field, but other internal ownership or scope identifiers can remain on a retained record. Those records can include generalized or user-authored workflow content, and we do not promise that every retained workflow can be individually attributed to or removed for one account. The Section 9 service-use license ends immediately upon termination.


14. Changes to Terms

We may modify these Terms or the Acceptable Use Policy. For material changes to these Terms or the Acceptable Use Policy, we will update the applicable Last updated date and provide reasonable notice by email, in-app notice, or website notice. Continued use after changes constitutes acceptance; if you do not agree, stop using Osera.


15. Governing Law and Disputes

These Terms are governed by Delaware law, without regard to conflict-of-law principles. Disputes are resolved through binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, except either party may seek injunctive relief for intellectual-property matters or bring a claim in small claims court. Bloom Street will pay arbitration filing fees for claims under $10,000.

Opt-out: You may opt out of arbitration by written notice to legal@osera.io within 30 days of first use. If you opt out, disputes will be resolved in Delaware state or federal courts. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.


16. Export Controls and Sanctions

Osera is operated from the United States. You agree to comply with applicable export-control and economic-sanctions laws, including those administered by the U.S. Department of Commerce and the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC). You represent that you are not located in, organized under the laws of, or a resident of a country or territory subject to comprehensive U.S. sanctions; are not identified on a U.S. government restricted-party list; and will not use Osera in violation of applicable export controls or sanctions. We may terminate access for a violation.


17. General Provisions

These Terms, the Acceptable Use Policy, and the Privacy Policy are the entire agreement regarding Osera. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign our rights and obligations. Nothing creates a partnership, employment, or agency relationship. Neither party is liable for delay from causes beyond reasonable control, including natural disasters, war, terrorism, epidemics, government action, sanctions, third-party failures, internet outages, or power failures.
